User Accounts ### 3.1 Account Creation - You must provide accurate and complete information when creating an account - You are responsible for maintaining the confidentiality of your account credentials - **Age Requirement**: You must be at least 13 years old (or 14 years old in Korea) to use this Service - Users under 14 in Korea need parental/legal guardian consent - We do not knowingly collect data from children under the applicable age limit - One person or legal entity may maintain no more than one account ### 3.2 Account Security - You are responsible for all activities that occur under your account - Notify us immediately of any unauthorized use of your account - We are not liable for any loss or damage arising from unauthorized account access ## 4. User Content ### 4.1 Your Content - You retain all rights to the dreams and content you submit to Novakitz - By submitting content, you grant us a license to use, store, and process your content solely to provide the Service - You are responsible for the content you post and must not post illegal, harmful, or offensive content ### 4.2 AI-Generated Content - Dream interpretations are generated by AI and are provided for entertainment and self-reflection purposes only - AI interpretations should not be considered professional psychological or medical advice - We do not guarantee the accuracy, completeness, or usefulness of AI-generated content ## 5. Subscription and Payment ### 5.1 Free and Premium Plans - Basic features are available for free with limitations - Premium features require a paid subscription through our payment processor (Gumroad) - Subscription fees are billed in advance on a monthly or annual basis ### 5.2 Payment Processing - Payments are processed by third-party payment processors - You agree to provide accurate payment information - You authorize us to charge your payment method for applicable fees ### 5.3 Cancellation - You may cancel your subscription at any time - Cancellations take effect at the end of the current billing period - No refunds will be provided for partial subscription periods except as required by law ### 5.4 Payment Processor Relationship Payments are processed by Gumroad, an independent third-party service. By subscribing, you also agree to: - Gumroad's Terms of Service - Gumroad's Privacy Policy We do not store your payment card information. All payment data is handled securely by Gumroad. ### 5.5 Electronic Financial Transactions (Korea) For Korean users, subscription payments are subject to the Electronic Financial Transactions Act (전자금융거래법). Transaction records are maintained for 5 years as required by Korean law. You have the right to request transaction records at any time. ### 5.6 Lifetime License Terms The Lifetime license is valid for the duration of the Service's operation. In the event of service discontinuation due to force majeure, company circumstances, or other unavoidable reasons, the Lifetime license validity may expire. We will provide reasonable notice before any planned service discontinuation. Lifetime licenses are non-refundable except as required by applicable law. ## 6. Privacy and Data Protection - Your use of the Service is also governed by our Privacy Policy - We collect and use your data as described in our Privacy Policy - We implement reasonable security measures to protect your data - We comply with applicable data protection laws including GDPR and CCPA ## 9. AI Services and Limitations ### 9.1 AI Interpretation - Dream interpretations are generated using artificial intelligence (Google Gemini) - AI interpretations are not professional advice - We do not guarantee accuracy or suitability of AI-generated content ### 9.2 Service Limitations - AI services have usage limits to ensure fair access - We reserve the right to limit or throttle excessive usage - Service availability may be subject to third-party AI provider limitations ### 9.3 Medical Disclaimer The Service is NOT: - A substitute for professional mental health care - Medical diagnosis or treatment - Crisis intervention service **If you are experiencing a mental health crisis, please contact appropriate emergency services immediately.** ## 10. Disclaimers ### 10.1 Service "As Is" THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. ### 10.2 Not Professional Advice THE SERVICE DOES NOT PROVIDE MEDICAL, PSYCHOLOGICAL, OR PROFESSIONAL ADVICE. DREAM INTERPRETATIONS ARE FOR ENTERTAINMENT AND SELF-REFLECTION PURPOSES ONLY. ### 10.3 Third-Party Services We are not responsible for third-party services integrated with our platform, including payment processors and AI providers. ## 11. Limitation of Liability TO THE MAXIMUM EXTENT PERMITTED BY LAW: - We are not liable for indirect, incidental, or consequential damages - Our total liability shall not exceed the amount you paid us in the past 12 months - We are not liable for damages resulting from service interruptions, data loss, or unauthorized access ## 12. Service Provider ### 16.1 Operator Novakitz is operated from the Republic of Korea. ### 16.2 Geographic Availability We make no representation that the Service is appropriate or available for use in all locations. Access from territories where the content is illegal is prohibited. ## 17. Children's Privacy The Service is not intended for children under 13. We do not knowingly collect information from children under 13. If we discover such information, we will delete it promptly. ## 18. Export Controls You agree to comply with all applicable export and import control laws and regulations in your use of the Service. ## 19. Entire Agreement These Terms, along with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Novakitz regarding the Service. ## 20.
